Terms of Service

Introduction

This Terms of Service Agreement ("Agreement") is a legal agreement between PT KONEKSI NUSANTARA INDONESIA ("konasan", "we", "us", or "our") and you ("Developer", "Publisher", "User", or "you") who registers for and uses our gaming payment services.

konasan provides gaming payment solutions, APIs, and related services to help game developers and publishers integrate payment systems into their games. By using our Services, you agree to be bound by these terms.

Please read these terms carefully. If you do not agree to these terms, do not use our Services.

Definitions

• "Services" means the gaming payment processing services, APIs, SDKs, and related tools provided by konasan.
• "Developer Account" means your account with konasan for accessing our Services.
• "Game" means any video game, mobile game, or interactive entertainment software that integrates with our Services.
• "Player" means end users who make payments through your Game using our Services.
• "Transaction" means any payment processed through our Services.
• "API" means our Application Programming Interface that allows integration with our Services.

Account Registration and Eligibility

Eligibility Requirements

To use our Services, you must:

• Be at least 18 years old or the legal age of majority in your jurisdiction
• Have the legal authority to enter into this Agreement
• Be a legitimate game developer or publisher
• Provide accurate, complete, and current information during registration
• Maintain and update your account information

Account Security

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Immediately notifying us of any unauthorized use of your account
• Using strong passwords and enabling two-factor authentication when available

Verification Process

We may require you to complete a verification process before accessing our Services. This may include providing business documentation, identity verification, and other information as required by applicable laws and regulations.

Use of Services

License to Use

Subject to your compliance with this Agreement, konasan grants you a limited, non-exclusive, non-transferable, revocable license to access and use our Services solely for integrating payment functionality into your Games.

API Usage

When using our APIs, you must:

• Comply with our API documentation and usage guidelines
• Respect rate limits and usage quotas
• Keep your API keys secure and confidential
• Not attempt to reverse engineer or bypass our systems

Prohibited Uses

You may not use our Services to:

• Process payments for illegal activities or prohibited content
• Circumvent security measures or access controls
• Interfere with or disrupt our Services
• Transmit viruses, malware, or other harmful code
• Violate any applicable laws or regulations
• Engage in money laundering or terrorist financing
• Process payments for adult content (unless specifically approved)
• Facilitate gambling where prohibited by law

Payment Processing

Transaction Processing

konasan facilitates payment processing between Players and your Games. We work with licensed payment processors and financial institutions to handle transactions securely.

Fees and Pricing

Our fees are disclosed during the registration process and may be updated from time to time. You agree to pay all applicable fees for using our Services. Fees are typically deducted from your transaction volume before settlement.

Settlement and Payouts

We will transfer funds from completed transactions to your designated bank account according to your payout schedule, minus applicable fees and reserves. Settlement timing depends on your account status and transaction volume.

Chargebacks and Disputes

You are responsible for all chargebacks, disputes, and refunds related to your Games. We may deduct chargeback amounts and fees from your account balance or future settlements.

Data and Privacy

Data Collection

We collect and process transaction data and other information necessary to provide our Services. Our Privacy Policy describes how we handle your data and Player information.

Your Obligations

You must:

• Comply with applicable data protection laws
• Obtain necessary consent from Players for data processing
• Implement appropriate security measures
• Provide clear privacy notices to Players
• Report any data breaches promptly

PCI DSS Compliance

If you handle payment card data, you must maintain compliance with Payment Card Industry Data Security Standard (PCI DSS) requirements.

Intellectual Property

konasan IP

All rights in our Services, APIs, SDKs, documentation, and related materials remain our exclusive property. You may not copy, modify, distribute, or create derivative works without our written permission.

Your Content

You retain ownership of your Games and related content. You grant us a limited license to use your content as necessary to provide our Services.

Trademark Usage

You may display our logos and marks only as specified in our brand guidelines and solely to indicate your use of our Services.

Liability and Indemnification

Limitation of Liability

To the fullest extent permitted by law, konasan shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business interruption.

Indemnification

You agree to indemnify and hold konasan harmless from any claims, damages, or expenses arising from:

• Your breach of this Agreement
• Your Games or business practices
• Your violation of applicable laws
• Third-party claims related to your use of our Services
• Chargebacks and disputes related to your transactions

Warranty Disclaimer

Our Services are provided "as is" without warranties of any kind. We do not guarantee uninterrupted or error-free service, and we disclaim all warranties, express or implied.

Termination

Termination by You

You may terminate this Agreement at any time by closing your Developer Account and discontinuing use of our Services.

Termination by konasan

We may terminate or suspend your access to our Services immediately if:

• You breach this Agreement
• You engage in fraudulent or illegal activities
• Your account poses a risk to our platform or other users
• You fail to cooperate with investigations
• Required by law or regulatory authorities

Effect of Termination

Upon termination:

• Your license to use our Services terminates immediately
• We may retain funds to cover potential chargebacks and liabilities
• You remain liable for all obligations incurred before termination
• Provisions that should survive termination will remain in effect

Dispute Resolution

Governing Law

This Agreement is governed by the laws of Indonesia. Any disputes will be resolved in the courts of Indonesia.

Dispute Process

Before initiating legal proceedings, you agree to:

• Contact our support team to attempt resolution
• Provide detailed information about the dispute
• Cooperate in good faith to resolve the issue

General Provisions

Amendments

We may update these terms from time to time. We will notify you of material changes, and your continued use of our Services constitutes acceptance of the updated terms.

Assignment

You may not assign this Agreement without our written consent. We may assign our rights and obligations without restriction.

Severability

If any provision of this Agreement is found to be unenforceable, the remaining provisions will continue in full force and effect.

Entire Agreement

This Agreement, together with our Privacy Policy and other referenced policies, constitutes the entire agreement between you and konasan regarding our Services.
